Jury Awards $1.42 Million in Mesothelioma Lawsuit Case

A company that made boiler gaskets containing asbestos fibers has been ordered to pay a sum of $1.42 million dollars to the family of a man who died from mesothelioma. It’s alleged that the asbestos-laden gaskets resulted in asbestos exposure that ultimately caused the man’s mesothelioma.

Mesothelioma lung cancer is a rare and very aggressive form of cancer which claims a majority of victims within just 12 months of diagnosis. This rang true for the victim in this case, a man named William Voelker who reportedly passed away in 2013 just four months after receiving his mesothelioma diagnosis.

Voelker’s widow and family filed suit against John Crane Inc., the manufacturer of the asbestos-containing boiler gaskets that the decedent reportedly handled while working aboard a U.S. Navy vessel.

More than four dozen companies were named in the Voelkers’ mesothelioma lawsuit, but just John Crane Inc. was found liable for the man’s asbestos exposure and subsequent mesothelioma diagnosis.

But some legal experts have said publicly that the company may ultimately be cleared of liability because the more than four dozen other defendants, which have reportedly been found liable in other asbestos exposure and mesothelioma lawsuit cases.

It was alleged in the lawsuit that the man experienced asbestos exposure as a child due to asbestos particles on his father’s clothing. The super small particles of asbestos can cling to a person’s hair or clothing. Movement or handling can cause those particles to become airborne, causing an individual to experience asbestos exposure when they ingest or inhale the tiny asbestos fibers.

Notably, John Crane Inc. was recently named as a defendant in another lawsuit involving a 70 year old South Carolina man who passed away due to mesothelioma lung cancer that is believed to have occurred as a result of asbestos exposure.

But John Crane Inc. was not found to be liable in that case, which ultimately led to a $14 million jury award. Another company, a polyester fiber manufacturer named Celanese Corp. was found liable in that case, although they reportedly plan to appeal the jury’s ruling.
